This AI and Automation Policy governs the use of artificial intelligence systems, machine learning systems, large language models, automated workflows, automated support systems, AI chatbots, AI sales assistants, AI support specialists, AI-enabled fulfilment systems, third-party AI processors, and any other automated or semi-automated systems used, made available, referenced, integrated, deployed, or relied upon by Win Better Clients in connection with winbetterclients.com and any associated pages, checkout pages, forms, portals, member areas, subdomains, domains, email addresses, platforms, tools, products, services, communications, support channels, fulfilment environments, or service environments owned, controlled, operated, or authorised for use by Win Better Clients.
By accessing the website, submitting information, communicating with Win Better Clients, interacting with any AI or automated system, purchasing any product or service, using any deliverable, or otherwise engaging with Win Better Clients, you acknowledge, consent to, accept, and agree to this AI and Automation Policy, together with the Terms and Conditions, Privacy Policy, Refund Policy, Disclaimer, Cookies Policy, and any applicable offer-specific terms.
Win Better Clients may, in its sole discretion, use AI systems, automation systems, software agents, algorithmic tools, machine learning models, large language models, retrieval systems, transcription systems, summarisation systems, classification systems, workflow tools, support automation, sales automation, fulfilment automation, data processing automation, analytics tools, and related technologies for service delivery, customer support, sales assistance, operational administration, product delivery, content organisation, internal review, quality control, fraud prevention, security, recordkeeping, customer communications, marketing operations, dispute handling, chargeback defence, knowledge management, and any other lawful business purpose.
Such systems may include models, software, APIs, platforms, infrastructure, tools, vendors, service providers, processors, subprocessors, hosting providers, and automation providers that are available to Win Better Clients from time to time. Win Better Clients may change, add, remove, replace, upgrade, downgrade, combine, or reconfigure any AI model, tool, vendor, workflow, or automation system at any time without prior notice.
You expressly authorise Win Better Clients to submit, transmit, disclose, route, process, store, transform, summarise, classify, analyse, retrieve, compare, enrich, or otherwise use your information, communications, account details, support requests, product usage records, order details, form submissions, chat messages, feedback, survey responses, implementation details, business context, and other non-sensitive information through AI systems and automation systems where Win Better Clients determines that such use is reasonably related to its business, products, services, support, fulfilment, administration, or legal interests.
Win Better Clients does not intend to submit complete payment card details or equivalent highly sensitive payment credentials to AI models for general AI processing. Payment-related information may be processed by payment processors and financial service providers under their own systems, terms, and legal obligations. You agree not to submit unnecessary sensitive personal information, payment credentials, government identifiers, passwords, confidential third-party information, privileged material, medical information, or other highly sensitive information to any AI chatbot, support form, message field, or automated system unless expressly requested through an appropriate secure channel.
You acknowledge that AI models, AI platforms, cloud systems, automation vendors, and third-party service providers may be owned, operated, hosted, trained, configured, secured, updated, logged, moderated, analysed, monitored, or otherwise processed by third parties outside the direct ownership and absolute control of Win Better Clients. Win Better Clients may take commercially reasonable or otherwise appropriate efforts to select, configure, instruct, restrict, monitor, and use such systems responsibly; however, Win Better Clients does not and cannot guarantee, represent, warrant, supervise, control, audit, or determine with certainty every internal processing operation, model behaviour, inference, retention practice, moderation action, training-related practice, output-generation process, or downstream technical operation of any third-party AI model or automation provider.
To the fullest extent permitted by law, you waive and release Win Better Clients from any claim, demand, liability, loss, damage, expense, refund request, chargeback, cancellation request, dispute, or cause of action arising out of or relating to the internal processing, technical operation, retention, security, moderation, model behaviour, output generation, inference, transformation, routing, or vendor-side handling of information by any third-party AI model, AI platform, automation tool, or related provider, except to the limited extent such waiver is expressly prohibited by applicable law.
AI-generated and automation-generated outputs may be incomplete, inaccurate, outdated, hallucinated, misleading, overbroad, underbroad, insensitive, offensive, inappropriate, inconsistent, non-contextual, internally contradictory, or otherwise unsuitable for your particular purpose. You acknowledge that AI systems are probabilistic or algorithmic tools and that even where Win Better Clients supplies guardrails, instructions, prompts, moderation rules, knowledge bases, product information, examples, restrictions, or escalation guidance, no AI model or automated system can be guaranteed to respond accurately, safely, consistently, or in accordance with every applicable policy in every circumstance.
Any AI output is provided for convenience, speed, preliminary assistance, operational support, or general informational purposes only. You must independently verify all important information, offer details, product terms, pricing, refund terms, legal terms, technical requirements, implementation advice, commercial assumptions, deadlines, commitments, and purchase-relevant facts before relying on any AI-generated or automation-generated response.
No statement, response, message, promise, assurance, explanation, recommendation, estimate, guarantee, refund indication, pricing indication, delivery indication, performance indication, eligibility indication, legal interpretation, product description, or other output generated by any AI chatbot, AI sales assistant, AI support specialist, automated workflow, automated message, or other non-human system shall bind Win Better Clients, modify any contract, alter any policy, waive any right, create any warranty, expand any refund right, create any entitlement, amend any offer, override checkout terms, establish reliance, constitute fraud, constitute authorised legal notice, or create any enforceable representation against Win Better Clients unless such statement is subsequently confirmed in an express written instrument manually issued by an authorised human representative of Win Better Clients with clear intent to be legally bound.
If any AI-generated or automated response conflicts with the Terms and Conditions, Privacy Policy, Refund Policy, Disclaimer, Cookies Policy, this AI and Automation Policy, any checkout terms, any product-specific terms, any written agreement, or any human-issued correction, then the applicable written policy, checkout term, agreement, or authorised human correction shall control, and the AI-generated or automated response shall be deemed void, non-binding, non-authoritative, and ineffective to the extent of such conflict.
You expressly agree that no purchase shall become fraudulent, void, voidable, illegitimate, unauthorised, defective, refundable, cancellable, chargeback-eligible, or otherwise subject to monetary remedy merely because an AI sales agent, AI chatbot, AI support specialist, automated assistant, or other automated system made, appeared to make, or was alleged to have made an inaccurate statement, inaccurate promise, exaggerated statement, incorrect assurance, mistaken refund indication, mistaken eligibility statement, mistaken product description, mistaken performance implication, mistaken legal conclusion, or any other inaccurate, unauthorised, unsupported, or unintended representation.
You acknowledge that Win Better Clients may use reasonable efforts to guardrail AI systems and provide adequate knowledge bases, instructions, restrictions, and operating parameters, but Win Better Clients does not have absolute control over AI behaviour, does not continuously pre-approve every AI-generated message, and does not provide complete real-time human supervision over every chatbot, sales-agent, support-agent, or automation interaction. Accordingly, AI-generated inaccuracies, unsupported statements, or unintended representations shall not create refund rights, chargeback rights, reliance rights, fraud claims, misrepresentation claims, cancellation rights, service-credit rights, contractual amendments, or other monetary or non-monetary remedies against Win Better Clients.
You acknowledge that AI systems can be manipulated, confused, redirected, jailbroken, prompt-injected, socially engineered, adversarially prompted, contextually misled, or induced to generate unintended, inaccurate, policy-violating, or unauthorised responses by the wording, framing, sequencing, omissions, instructions, hidden instructions, screenshots, copied text, external references, role-play prompts, exploit attempts, or other inputs supplied by users or third parties. You shall not attempt to manipulate, jailbreak, bypass, override, exploit, reverse engineer, induce, coerce, or otherwise misuse any AI system, automation system, guardrail, safety system, access control, instruction hierarchy, knowledge base, moderation system, support system, or sales system made available by or through Win Better Clients.
Win Better Clients shall not be responsible for any AI response, output, failure, omission, error, inaccuracy, offensive statement, unauthorised promise, harmful response, or policy-violating output that is caused, contributed to, invited, influenced, exacerbated, induced, or made possible by user-side conduct, user-supplied prompts, incomplete information, adversarial prompting, jailbreaking attempts, misleading context, misuse, abuse, third-party interference, or any other circumstance outside the absolute control of Win Better Clients.
Any message, instruction, representation, acknowledgement, admission, request, approval, consent, confirmation, factual statement, business information, payment-related statement, refund-related statement, dispute-related statement, purchase-related statement, support-related statement, or other communication submitted by you or from your device, account, email address, phone number, payment identity, browser session, IP address, customer record, or other attributable channel to an AI system, automated system, chatbot, support assistant, sales assistant, form, or communication channel may be recorded, retained, reviewed, relied upon, and treated by Win Better Clients as your own intentional communication for contractual, operational, evidentiary, compliance, dispute, refund, chargeback, fraud-prevention, security, and legal purposes.
You remain solely responsible for all information, requests, statements, instructions, prompts, and communications you submit to any AI or automated system. Your communications to an AI or automated system may create legally relevant admissions, confirmations, consents, acknowledgements, instructions, notices, and records against you to the fullest extent permitted by law, because you, and not the AI system, are in ultimate control of the content you choose to send.
Win Better Clients may record, log, store, preserve, monitor, review, analyse, summarise, export, reproduce, and use AI chats, chatbot transcripts, support transcripts, sales transcripts, automation events, user prompts, system outputs, metadata, timestamps, device information, IP information, account records, order records, access records, usage records, and related communications for service delivery, support, quality control, training, product improvement, fraud prevention, abuse detection, legal compliance, policy enforcement, refund evaluation, payment dispute defence, chargeback defence, internal administration, and protection of Win Better Clients' rights and interests.
Such records may be used by Win Better Clients in responding to customer requests, evaluating refund eligibility, investigating misuse, defending payment disputes, establishing notice, proving delivery, proving user acknowledgement, proving policy abuse, establishing user-side manipulation or prompting, or otherwise protecting the legal, commercial, operational, and evidentiary interests of Win Better Clients.
AI and automated systems made available by Win Better Clients do not provide legal, tax, accounting, financial, investment, regulatory, employment, medical, therapeutic, or other licensed professional advice. No AI or automation output should be treated as professional advice, final business advice, final legal interpretation, compliance approval, or personalised professional judgement.
Win Better Clients does not guarantee that any AI-generated or automation-generated message will be reviewed by a human before or after it is sent. Human involvement, escalation, moderation, review, or correction may occur in Win Better Clients' sole discretion, but the absence of human review shall not create liability, refund rights, reliance rights, or any other remedy.
You are solely responsible for your purchase decisions, business decisions, implementation decisions, legal compliance, reliance decisions, communication decisions, use of AI outputs, and verification of any information provided by AI or automation systems. AI systems are provided for convenience and faster responses only and are not a substitute for natural human review, independent judgement, professional advice, contract review, or direct confirmation from an authorised human representative of Win Better Clients.
You agree that you will not rely exclusively on AI-generated statements when making purchase decisions, refund decisions, implementation decisions, commercial decisions, legal decisions, or any other material decision. You further agree that any alleged reliance on AI-generated or automated output shall be unreasonable as a matter of contract unless the same information was expressly confirmed in binding written terms or by an authorised human representative of Win Better Clients.
AI systems and automation systems may be unavailable, delayed, rate-limited, interrupted, degraded, inaccurate, modified, suspended, discontinued, or affected by third-party outages, provider changes, API limitations, model changes, moderation systems, security restrictions, account restrictions, vendor policies, internet failures, data processing delays, or other technical, operational, commercial, or legal factors. Win Better Clients does not warrant that any AI or automated system will be continuously available, error-free, uninterrupted, complete, current, or suitable for your purposes.
No failure, limitation, inaccuracy, interruption, degradation, delay, unavailability, provider change, or discontinuation of any AI or automation system shall, by itself, entitle you to any refund, credit, cancellation, chargeback, reimbursement, damages, extension, replacement, or other remedy unless expressly required by applicable law or expressly promised in a separate binding written agreement.
To the fullest extent permitted by law, all AI systems, automation systems, chatbot responses, automated messages, model outputs, analyses, recommendations, summaries, classifications, drafts, workflows, and related technologies are provided on an "as is," "as available," "with all faults," and "use at your own risk" basis. Win Better Clients disclaims all warranties, whether express, implied, statutory, or otherwise, including warranties of accuracy, reliability, completeness, timeliness, merchantability, fitness for a particular purpose, title, non-infringement, uninterrupted operation, security, compliance, compatibility, or suitability.
To the fullest extent permitted by law, Win Better Clients shall not be liable for any direct, indirect, incidental, special, consequential, exemplary, punitive, aggravated, reliance-based, expectation-based, restitutionary, or similar damages, losses, claims, costs, or expenses arising out of or relating to AI systems, automation systems, AI-generated output, chatbot responses, automated messages, third-party AI processing, model errors, hallucinations, inaccurate promises, offensive responses, delayed responses, unavailable systems, user manipulation, jailbreaking, misuse, vendor conduct, data processing by third-party models, or any reliance upon any AI or automated output.
To the fullest extent permitted by law, the total aggregate liability of Win Better Clients for any claim arising out of or relating to this AI and Automation Policy or any AI or automation system shall not exceed the amount actually paid by you to Win Better Clients for the specific product or service directly giving rise to the claim, and where no amount was paid for the specific interaction or system, the liability shall be zero to the maximum extent permitted by law.
You agree to defend, indemnify, and hold harmless Win Better Clients and its brand operators, affiliates, licensors, contractors, vendors, service providers, processors, subprocessors, successors, assigns, officers, personnel, agents, and representatives from and against any claims, demands, liabilities, losses, damages, judgments, settlements, penalties, fines, costs, and expenses, including reasonable attorneys' fees, arising out of or relating to your use of any AI or automated system, your prompts or communications, your reliance on AI output, your failure to verify information, your submission of sensitive or unlawful information, your misuse of AI systems, your attempted jailbreaking or manipulation, your breach of this AI and Automation Policy, your violation of any third-party rights, your refund or chargeback claim based on AI output, or any claim brought by a third party arising from your use of AI-generated or automation-generated output.
This AI and Automation Policy is incorporated into and forms part of the Terms and Conditions, Privacy Policy, Refund Policy, Disclaimer, Cookies Policy, and any applicable offer-specific terms. In the event of any inconsistency between this AI and Automation Policy and any AI-generated or automation-generated statement, this AI and Automation Policy shall control. In the event of any inconsistency between this AI and Automation Policy and a more specific written agreement manually executed or expressly issued by an authorised human representative of Win Better Clients, the more specific written agreement shall control only to the limited extent of the inconsistency.
Win Better Clients reserves the right to modify, update, replace, supplement, or revise this AI and Automation Policy at any time. The updated version will be effective when posted on the website unless otherwise stated. Continued use of the website, services, products, AI systems, automation systems, chatbots, support channels, or communications after changes are posted constitutes acceptance of the updated policy.
This AI and Automation Policy and any disputes relating to it shall be governed by and construed in accordance with the laws applicable in Agartala, Tripura. Any disputes arising out of or relating to this AI and Automation Policy shall be subject to the exclusive jurisdiction of the courts in Agartala, Tripura.
